Deze Algemene Voorwaarden zijn van toepassing op alle bezoeken aan en gebruik van de Webshop, alsmede op alle overeenkomsten die via de Webshop worden gesloten. Door gebruik te maken van de Webshop accepteert u deze voorwaarden. Graafwillem Merchandise behoudt zich het recht voor deze voorwaarden te wijzigen. Graafwillem Merchandise behoudt zich het recht voor diensten op elk moment te wijzigen, op te schorten of te beëindigen, zonder voorafgaande kennisgeving en zonder aansprakelijkheid jegens de Klant.
Het gebruik van de Webshop is uitsluitend toegestaan aan personen die wettelijk bevoegd zijn om overeenkomsten aan te gaan. Conform de Algemene Verordening Gegevensbescherming (AVG) en de nationale wetgeving in Nederland en België is de minimumleeftijd voor het aanmaken van een account en het plaatsen van bestellingen 16 jaar. Personen onder de 16 jaar mogen de Webshop uitsluitend gebruiken onder toezicht en met uitdrukkelijke toestemming van een ouder of wettelijk voogd, die daarmee de aansprakelijkheid op zich neemt.
Door een ontwerp, afbeelding of ander materiaal te uploaden op de Webshop, garandeert de Klant uitdrukkelijk dat:
De Klant vrijwaart Graafwillem Merchandise en de Productiepartner volledig voor alle aanspraken van derden die voortvloeien uit het gebruik van door de Klant aangeleverd materiaal. Graafwillem Merchandise behoudt zich het recht voor een bestelling te weigeren of te annuleren bij vermoeden van inbreuk op rechten van derden.
Alle rechten op de Webshop, inclusief maar niet beperkt tot ontwerpen, teksten, afbeeldingen, software en merkidentiteit, berusten bij Graafwillem Merchandise of haar licentiegevers. Niets op de Webshop mag worden gereproduceerd, gedistribueerd of openbaar gemaakt zonder uitdrukkelijke schriftelijke toestemming van Graafwillem Merchandise.
Graafwillem Merchandise is uitsluitend aansprakelijk voor directe schade die het rechtstreekse gevolg is van een toerekenbare tekortkoming van Graafwillem Merchandise. Graafwillem Merchandise is in geen geval aansprakelijk voor:
De totale aansprakelijkheid van Graafwillem Merchandise is in alle gevallen beperkt tot het bedrag dat de Klant voor de betreffende bestelling heeft betaald.
Graafwillem Merchandise en de Productiepartner zijn niet aansprakelijk voor het niet of niet tijdig nakomen van verplichtingen als gevolg van omstandigheden die buiten hun redelijke controle vallen, waaronder maar niet beperkt tot: brand, overstroming, stakingen, pandemieën, overheidsmaatregelen, tekort aan grondstoffen, storingen bij toeleveranciers of vervoerders, en verstoringen van telecommunicatie- of energieinfrastructuur. In geval van overmacht wordt de uitvoering opgeschort voor de duur van de overmachtssituatie.
De Klant verbindt zich ertoe de Webshop uitsluitend te gebruiken in overeenstemming met de wet en deze voorwaarden. Verboden gedragingen omvatten onder meer:
Graafwillem Merchandise behoudt zich het recht voor om bij overtreding de toegang van de Klant onmiddellijk en zonder voorafgaande kennisgeving te blokkeren of te beëindigen.
De Klant is verantwoordelijk voor het vertrouwelijk houden van zijn inloggegevens en voor alle activiteiten die via zijn account plaatsvinden. Graafwillem Merchandise is niet aansprakelijk voor schade die voortvloeit uit ongeautoriseerde toegang tot het account van de Klant, tenzij dit het gevolg is van een aantoonbare tekortkoming van Graafwillem Merchandise.
De verwerking van persoonsgegevens geschiedt in overeenstemming met het Privacybeleid van Graafwillem Merchandise, dat beschikbaar is op de Webshop. Door gebruik te maken van de Webshop gaat de Klant akkoord met dit Privacybeleid.
Bij het plaatsen van een bestelling of het aanvragen van een offerte worden uw persoonsgegevens opgeslagen op servers buiten de Europese Unie. Door gebruik te maken van onze diensten gaat u hiermee akkoord.
Klachten over producten of diensten dienen binnen 5 werkdagen na ontvangst schriftelijk te worden gemeld via amir@theoven.nl, met opgave van het ordernummer en foto's van het gebrek. Graafwillem Merchandise streeft ernaar klachten binnen 10 werkdagen af te handelen. Voor meer informatie verwijzen wij naar het Retour- en Reclamatiebeleid op de Webshop.
Op alle overeenkomsten en geschillen die voortvloeien uit het gebruik van de Webshop is het recht van toepassing van het land waar Graafwillem Merchandise is gevestigd. Geschillen worden bij voorkeur in onderling overleg opgelost. Indien dit niet mogelijk is, worden geschillen voorgelegd aan de bevoegde rechter. Consumenten in België en Nederland behouden het recht een beroep te doen op alternatieve geschillenbeslechting (o.a. ODR-platform van de Europese Commissie via ec.europa.eu/consumers/odr).
De meest recente versie van deze Algemene Voorwaarden is altijd beschikbaar op de Webshop. Ingrijpende wijzigingen worden, indien mogelijk, per e-mail gecommuniceerd. Voortgezet gebruik van de Webshop na wijziging geldt als aanvaarding van de nieuwe voorwaarden.

By uploading a design, image or other material to the Webshop, the Customer expressly warrants that:
The Customer fully indemnifies Graafwillem Merchandise and the Production Partner against all third-party claims arising from the use of material submitted by the Customer. Graafwillem Merchandise reserves the right to refuse or cancel an order if infringement of third-party rights is suspected.
All rights to the Webshop, including but not limited to designs, texts, images, software and brand identity, vest in Graafwillem Merchandise or its licensors. Nothing on the Webshop may be reproduced, distributed or published without the express written consent of Graafwillem Merchandise.
Graafwillem Merchandise is only liable for direct damage that is the direct result of an attributable failure by Graafwillem Merchandise. Graafwillem Merchandise is not liable in any case for:
The total liability of Graafwillem Merchandise is in all cases limited to the amount paid by the Customer for the relevant order.
Graafwillem Merchandise and the Production Partner are not liable for failure to fulfil obligations due to circumstances beyond their reasonable control, including but not limited to: fire, flooding, strikes, pandemics, government measures, shortage of raw materials, supplier or carrier failures, and disruptions to telecommunications or energy infrastructure. In the event of force majeure, performance is suspended for the duration of the event.
The Customer agrees to use the Webshop only in accordance with applicable law and these terms. Prohibited conduct includes:
Graafwillem Merchandise reserves the right to immediately block or terminate a Customer’s access upon violation, without prior notice.
The Customer is responsible for keeping login credentials confidential and for all activities conducted via their account. Graafwillem Merchandise is not liable for damage arising from unauthorised access to the Customer’s account, unless this is the direct result of an attributable failure by Graafwillem Merchandise.
Personal data is processed in accordance with the Privacy Policy of Graafwillem Merchandise, available on the Webshop. By using the Webshop, the Customer agrees to this Privacy Policy.
When placing an order or requesting a quote, your personal data will be stored on servers outside the European Union. By using our services, you agree to this.
Complaints regarding products or services must be submitted in writing within 5 working days of receipt to amir@theoven.nl, including the order number and photographs of the defect. Graafwillem Merchandise aims to resolve complaints within 10 working days. Please refer to the Return & Complaints Policy on the Webshop for further information.
All agreements and disputes arising from use of the Webshop are governed by the law of the country in which Graafwillem Merchandise is established. Disputes will preferably be resolved by mutual agreement. If this is not possible, disputes will be submitted to the competent court. Consumers in Belgium and the Netherlands retain the right to use alternative dispute resolution, including the European Commission’s ODR platform at ec.europa.eu/consumers/odr.

La responsabilité totale de Graafwillem Merchandise est en tout état de cause limitée au montant payé par le Client pour la commande concernée.
Graafwillem Merchandise et le Partenaire de production ne sont pas responsables du non-respect de leurs obligations en raison de circonstances indépendantes de leur volonté raisonnable, notamment : incendie, inondation, grèves, pandémies, mesures gouvernementales, pénurie de matières premières, défaillances de fournisseurs ou transporteurs, et perturbations des infrastructures de télécommunication ou d’énergie. En cas de force majeure, l’exécution est suspendue pour la durée de l’événement.
Le Client s’engage à utiliser la Boutique conformément à la loi et aux présentes conditions. Les comportements interdits comprennent notamment :
Graafwillem Merchandise se réserve le droit de bloquer ou résilier immédiatement l’accès d’un Client en cas de violation, sans préavis.
Le Client est responsable de la confidentialité de ses identifiants de connexion et de toutes les activités effectuées via son compte. Graafwillem Merchandise n’est pas responsable des dommages résultant d’un accès non autorisé au compte du Client, sauf si cela résulte directement d’un manquement imputable à Graafwillem Merchandise.
Les données personnelles sont traitées conformément à la Politique de confidentialité de Graafwillem Merchandise, disponible sur la Boutique. En utilisant la Boutique, le Client accepte cette Politique de confidentialité.
Lors du passage d’une commande ou de la demande d’un devis, vos données personnelles seront stockées sur des serveurs en dehors de l’Union européenne. En utilisant nos services, vous acceptez cette condition.
Toute réclamation relative à des produits ou services doit être soumise par écrit dans les 5 jours ouvrables suivant la réception à amir@theoven.nl, avec le numéro de commande et des photos du défaut. Graafwillem Merchandise s’engage à traiter les réclamations dans les 10 jours ouvrables. Veuillez consulter la Politique de retour et réclamations sur la Boutique pour plus d’informations.
Tous les contrats et litiges découlant de l’utilisation de la Boutique sont régis par le droit du pays dans lequel Graafwillem Merchandise est établi.
